Barbara was walking her normal route to work with her husband in the early morning hours of August 20, 2012.

Part of her route was through a dimly-lit parking lot that saw high pedestrian and vehicular travel through the day and night.

As she was walking, Barbara was struck at an angle by a multi-ton garbage truck and dragged for a significant distance, de-gloving the skin and tissue from her leg.

Her husband, Carmen, who was across the street, heard her screams and hollered to the truck driver to stop. The driver did not hear Carmen and continued on, Barbara underneath.

Barbara underwent a total of 12 surgeries related to her extensive lower extremity injuries and still continues to receive regular medical treatment today.

Joe Messa and Jenimae Almquist of Messa & Associates proved that Barbara’s injuries were caused by the defendant driver’s negligence and the unsafe design and defective/inadequate lighting of the parking lot. Barbara and her husband Carmen were awarded a $5.2 Million settlement.
